Two policies issued by subsidiaries of AIG Property Casualty US Inc. require the insurer to defend Aloha Petroleum Ltd. in climate change lawsuits pending in Hawaii, a federal court said.
Originally at issue were 12 policies issued to Aloha by National Union Fire Insurance Co. of Pittsburgh, Pa. and American Home Assurance Co. Judge Jill A. Otake of the US District Court for the District of Hawaii previously ruled that AIG wasn’t liable to defend Aloha under 10 of the policies because of their pollution exclusion clauses.
