AI-focused talent recruiting firm Mercor.io Corp. and its vendors Delve AI Inc. and LiteLLM negligently failed to protect the personal information of workers and job seekers that was exposed in a March data breach, a proposed federal class action said.
The lawsuit appears to be just the second to be filed in federal court under the Illinois Artificial Intelligence Video Interview Act, a 2020 law that requires employers using AI to analyze video interviews to notify applicants, explain how the AI works, obtain their consent, and comply with data-retention and -deletion requirements.
