Agricultural technology company Indigo Ag Inc. will face trial on whether it fired a regional account manager because he is Black and was over the age of 40.
The ruling Thursday by the US District Court for the District of Colorado said Indigo’s good-faith business judgment for terminating employees for failing to meet performance metrics couldn’t be second-guessed. The court found whether that judgment here “was applied across racial and age differences” raised issues of fact sufficient to deny the Boston-based company’s motion for summary judgment the worker’s discrimination claims under federal and Colorado law.
