ADP 401(k) Plan Participants’ Jury Trial Bid Denied in ERISA Row

A group of more than 50,000 Automatic Data Processing Inc. 401(k) plan participants lost their bid to have a jury hear their class action claims that the human resources management software company allowed its retirement plan to pay excessive fees.

ADP TotalSource Group Inc. and the other defendants won their motion to strike the participants’ jury demand because they are seeking an “equitable remedy” that doesn’t warrant a jury trial, said Magistrate Judge José R. Almonte of the US District Court for the District of New Jersey.
