Acer Calls Ericsson Suit ‘Forum-Shopping’ in 5G Patent Dispute

Acer Inc. told a Delaware federal judge Ericsson Inc.’s patent lawsuit over 4G and 5G technology is an attempt for a “second bite of the apple” to litigate a dispute already playing out in Texas.

Ericsson, a supplier for AT&T Inc., T-Mobile USA Inc., and Verizon Communications Inc., isn’t the sole provider for the mobile carriers’ infringing base stations, according to Acer’s brief supporting its motion to dismiss filed Monday. Acer said Ericsson could intervene in the Texas suits, but the telecommunications giant chose to file a “duplicative” declaratory action for noninfringement.
