A proposed class action alleging that Accucom Corp. used people’s personal information without their consent to advertise its background-check website will remain in federal court rather than being sent to an arbitrator.
A visit by plaintiff Marilyn Azuz’s attorney to Accucom’s InfoTracer website wasn’t enough to bind her to the website’s mandatory arbitration provision, Judge Steven C. Seeger of the US District Court for the Central District of California said Wednesday.
Seeger denied Accucom’s motion to compel arbitration.
