Abt Electronics shed an Illinois Biometric Information Privacy Act claim from a former worker’s employment lawsuit after saying it already settled a related class action in state court.
Plaintiff Justin Gibbs fit within the settlement class definition and didn’t tell the US District Court for the Northern District of Illinois that he timely objected to it. Instead, he said he didn’t receive notice of the settlement that had been sent to his last known address.
