A full slate of Ninth Circuit judges will consider if Idaho should be allowed to enforce its near-total abortion ban in emergency situations while litigation proceeds.
The US Court of Appeals for the Ninth Circuit announced Tuesday that the full court will rehear arguments over a preliminary injunction that stopped the law’s enforcement against hospitals that are subject to the federal Emergency Medical Treatment and Labor Act. The court didn’t give any reason for its action, and said only that a majority of its nonrecused active judges voted to rehear the case.
