Abolishing Cash Bail Constitutional, Top Illinois Court Says (1)

Illinois is poised to become the first state in the nation to completely eliminate cash bail after the Illinois Supreme Court Tuesday ruled the state’s newly enacted laws that end cash bail are constitutional.

The two laws radically change the state’s pre-trial release process by abolishing the state’s existing cash bail system and declaring all defendants “shall be eligible for pretrial release” unless a judge rules they are a flight risk or pose a danger to the community.

The new laws were ruled unconstitutional by a Kankakee County, Ill. circuit court judge, but Tuesday’s 5-2 ruling reversed that decision. In ...
