ABM Gets Ex-Worker’s Class Wage Suit to Remain in Federal Court

A former ABM Aviation Inc. worker lost her bid to remove her proposed wage and hour class action from federal court back to state court.

ABM sufficiently demonstrated it met the Class Action Fairness Act’s minimum diversity and exceeded the $5 million amount in controversy requirement to establish federal jurisdiction, Judge Otis D. Wright II, of the US District Court for the Central District of California, said. The district court denied Keimyah Williams’ motion to remand the suit that asserts seven claims including failure to pay minimum wages and overtime wages under California law, among others.
