Pierre Fabre Trims Some Claims From Suit Over Benzene in Shampoo

Pierre Fabre United States Inc. trimmed some claims in a proposed class action alleging its Klorane brand of dry shampoo contains benzene, but must defend allegations that it sold adulterated products.

The plaintiffs assert that they wouldn’t have purchased the products or would have paid less for them had they known they contained benzene, a chemical the Food and Drug Administration has determined can cause cancer in humans.

The claims of selling adulterated products under the Illinois Consumer Fraud Act and other states’ consumer fraud acts aren’t preempted by federal law because they don’t rely on state law requirements that ...
