90 Degree Benefits Stuck With California Claim Over Data Breach

90 Degree Benefits will face a narrowed data breach class suit after a federal court granted in part a motion to dismiss from the healthcare benefits administrator.

The plaintiff sufficiently asserted standing to pursue claims for past harm and adequately alleged a cause of action under the California Consumer Privacy Act, the US District Court for the Eastern District of Wisconsin said Wednesday.

Rodney Johnson claimed he spent time checking for identity theft in the aftermath of the breach caused by a hacker gaining access to 90 Degree’s computer systems and obtaining the personal information of several thousand people.
