3M Wins Again Over Michigan’s Anti-PFAS Drinking Water Rule

3M Co. on Friday won another round in a years-long legal battle with Michigan environmental regulators about a rule limiting so-called “forever chemicals” in drinking water.

A Michigan Court of Appeals panel ruled 2-1 to uphold a trial judge’s ruling that the state Department of Environment, Great Lakes, and Energy violated the state Administrative Procedures Act because its statement on the impact on the 2020 rule at issue didn’t properly disclose the cost of compliance in curbing excessive per- and polyfluoroalkyl substances in drinking water.
