Uber Technologies Inc. is getting a second chance to argue that a child accepting terms and conditions in its app on a parent’s phone can force riders to enter binding arbitration instead of bringing injury claims in court.
A state appeals court revived Uber’s effort to send claims from two New Jersey passengers to arbitration Friday. The trial judge incorrectly held the ride-hailing giant’s terms weren’t clear and properly agreed to due to the plaintiff’s claim that their daughter—not them—had clicked agreement to terms of service on the app.
