OpenAI, Microsoft Push for Records on Times’ Use of ChatGPT Tool

OpenAI Inc. and Microsoft Corp. are sparring with New York Times Co. over whether the newspaper’s use of OpenAI’s LLMs are relevant to its landmark copyright lawsuit over the tech giants’ use of Times articles to train ChatGPT.

The 80,000-plus logs from an internal AI tool used by the Times are critical to show OpenAI’s LLMs are used in ways that don’t infringe copyrights, OpenAI and Microsoft argued in separate briefs filed Aug. 22. The same day, the Times said the documents aren’t relevant to its claim of contributory copyright infringement when ChatGPT is used to generate infringing outputs.
