NetChoice LLC took a loss before the Fifth Circuit on Thursday in its First Amendment fight against state laws requiring website operators to verify user age before allowing them access to content inappropriate for minors.

A lower court improperly granted a preliminary injunction against Mississippi’s age-verification law because it failed to undertake a sufficiently detailed factual analysis before concluding that NetChoice was likely to succeed on the merits of its challenge to the law, Judge Patrick E. Higginbotham said for the US Court of Appeals for the Fifth Circuit.
