The commercial speech exception in the Texas anti-SLAPP statute prevents quick dismissal of a lawsuit accusing attorneys of defaming a physician in television commercials that seek additional clients to sue him, the Texas Court of Appeals, Eighth District, held Nov. 25 (Miller Weisbrod, LLP v. Llamas-Soforo, 2014 BL 333876, Tex. App. 8th Dist., 08-12-00278-CV, 11/25/14).
The advertisements come within the statutory exclusion for commercial speech because they concerned the sale of the lawyers’ legal services to potential customers, the court concluded in an opinion by Justice Yvonne T. Rodriguez.
