Lawyer, Not His P.C., Is Liable for Overbilling

Rendering legal services in a probate case through a professional corporation did not prevent an attorney from being held personally liable for the excessive fees he charged, the North Dakota Supreme Court decided Oct. 13 (In re Estate of Amundson (Gleason v. Magers), 2015 BL 336540, N.D., 20150046, 10/13/15).

“[L]awyers practicing in a professional corporation still owe duties to clients and remain personally liable to them for acts of improper or unethical behavior that are related to the rendering of the professional legal service,” Justice Dale V. Sandstrom wrote.
