A trademark dispute between Zo Skin Health Inc. and Skincare Market Inc. was transferred from a Nebraska federal court to a California federal court on Friday.
Zo, which manufactures and sells FDA-regulated cosmetic products, sued Skincare Market in September 2021 in the U.S. District Court for the District of Nebraska. Zo alleged that Skincare Market illegally sold products bearing the Zo trademark on its website.
Skincare Market argued in its motion to dismiss or transfer the case that the Nebraska court lacked personal jurisdiction because both businesses are based in California.
