Zimmer Biomet Wins Heraeus Bone Cement Fight at ITC

Zimmer Biomet won a U.S. International Trade Commission case in which it was accused of stealing Heraeus trade secrets for bone cement, the compound used to fill the gap between an artificial joint and a bone, according to a notice posted on the agency’s electronic docket.

  • The commission rejected Heraeus’s request to block imports of Zimmer Biomet’s Refobacin bone cements made in France that competes with Heraeus’s Palacos product
  • The commission affirmed ITC Judge Cameron Elliot’s findings that Heraeus hadn’t established that any “injury” occurred to a domestic industry
