YouTuber ‘Sargon’ Can Use Election Night Clinton Party Clips

A British YouTuber’s mocking use of a comedian’s video from Hillary Clinton’s 2016 election night party was allowable as fair use under copyright law, a Manhattan federal court ruled.

Carl Benjamin—a.k.a. Sargon of Akkad—made legal use of Akilah Hughes’ video as transformative criticism, the court said.

Hughes’ YouTube channel covers topics including “comedy, race, social commentary, feminism, beauty, and fashion,” the court said. She attended Hillary Clinton’s campaign election night party in Manhattan in 2016, and posted a 10-minute video called “We Thought She Would Win” that included footage of the party and Hughes’ commentary on the night as it ...
