Wine School Loses Bid to Block Competitor in Trademark Dispute

A Phildelphia business lost an effort to bar a competitor from using the branding of “Philly Wine School.”

While PhillyWine LLC claims to have used the name first, it hasn’t shown it’s likely to succeed on the merits of its claim, the US District Court for the Eastern District of Pennsylvania said in an opinion denying a preliminary injuction.

“At best, it has shown that it and its predecessor business have used the term sporadically until the last couple of years,” while the competitor has used the term for nearly a decade, Judge Joshua D. Wolson said.
