Williams-Sonoma’s Copyright Claim Over Amazon Photo Use Survives

Amazon.com Inc.‘s use of a photo of Williams-Sonoma Inc.‘s famous Peppermint Bark could have infringed its copyright, a San Francisco federal court said.

The U.S. District Court for the Northern District of California on Monday denied Amazon’s motion to dismiss Williams-Sonoma’s copyright claim from the companies’ larger IP dispute over Amazon’s sales of Williams-Sonoma products.

Amazon was sued by Williams-Sonoma in 2018 for allegedly using its trademarks to resell its products on a Williams-Sonoma-branded page, wrongly implying the company authorized the sales or was affiliated with Amazon. The trademark claims survived Amazon’s motion to dismiss last year.
