Wearable health-tracker company Whoop Inc. won an order blocking a Chinese company from selling fitness bands accused of infringing the US-based company’s trade dress while its lawsuit proceeds.
Shenzhen Lexqi Electronic Technology Co.'s products are likely to cause consumer confusion as they have “unmistakable” similarities and that “particularly from a distance, the two devices are virtually indistinguishable” from Whoop’s, Judge F. Dennis Saylor IV said in an order Monday granting a preliminary injunction.
Saylor also said Whoop showed its trade dress—"a continuous fabric band that wraps over the device (i.e., a faceless device) with thin metal accents on the side"— ...
