Whether ‘Moo Duk Kwan’ Is Generic For Korean Martial Art Is Undetermined

An unresolved question of genericness prevented summary judgment in a trademark dispute between Korean-style martial arts entities over the term “Moo Duk Kwan” and a fist-and-laurel-leaves logo, the Middle District of Pennsylvania ruled Aug. 4 (United States Soo Bahk Do Moo Duk Kwan Fed’n, Inc. v. Int’l Tang Soo Do Moo Duk Kwan Ass’n, 2014 BL 215130, M.D. Pa., 3:12-cv-00669-RDM, 8/4/14).

The court found numerous unanswered questions regarding the origins and meanings of the putative trademarks and thus declined to resolve the matter at summary judgment.
