Weightlifting Company’s Trademark Win Mostly Upheld on Appeal

Max Rack Inc., which makes weightlifting equipment, had its trademark infringement win against a competitor mostly upheld after the Sixth Circuit found the trial court correctly rejected the defendant’s request for judgment as a matter of law or a new trial, but also rejected the jury’s $1 million damages award.

However, the two of the three appeals court judges ruled Thursday that the US District Court for the Southern District of Ohio incorrectly awarded Max Rack attorneys’ fees and doubled its profits award to $500,000.
