Wearable technology company Whoop Inc. told a federal court Finnish company Polar Electro Oy infringed the trade dress of its fitness band.
Polar made a “wholesale copy” of Whoop’s trade dress, including the use of a “continuous fabric band wrapped across the device to create a faceless front” and “metallic accents around the device,” Whoop said in a complaint filed Tuesday in the US District Court for the Eastern District of New York.
