A jury determined
Walmart’s Backyard Grill trademark was likely to cause confusion with Variety Stores Inc.'s Backyard and Backyard BBQ marks used to sell lawn and garden goods, the U.S. District Court for the Eastern District of North Carolina jury ruled Feb. 12.
The jury said Walmart willfully infringe the trademarks and awarded Variety more than $45 million in royalties and $50 million in profits.
