Volkswagen Scores Patent Office Review of Patent in ITC Case

Volkswagen Group of America Inc. convinced a patent office tribunal to review a semiconductor device patent that is part of an infringement investigation at the U.S. International Trade Commission.

Volkswagen asked the Patent Trial and Appeal Board to review Arigna Technology Ltd.’s U.S. Patent No. 8,247,867 in July, arguing it covers an invention that’s obvious and not novel. The board found Volkswagen was likely to show at least one of the patent claims is invalid.

The PTAB has been reluctant to review patents that are part of a parallel case at the ITC.
