VLSI Fraud Suit Over PQA Patent Challenge Returns to State Court

VLSI Technology LLC convinced a federal judge to remand its $3.2 million abuse of process and fraud case over Patent Quality Assurance LLC’s alleged abuse at the Patent Trial and Appeal Board to a state court where it was initially filed.

Judge M. Hannah Lauck was “persuaded by other courts who generally have held that a federal question is not raised by a state law abuse of process claim premised on abuse of a federal process,” she wrote in her opinion issued Thursday in the US District Court for the Eastern District of Virginia.
