Vizio Attorney Fee Award Upheld in Streaming Patents Case Appeal

Vizio Inc. beat a patent owner’s appellate bid to throw out a Texas federal court’s attorney fees award in a case concerning the electronics maker’s Smartcast streaming platform for its TVs.

The district court didn’t abuse its discretion in ordering Ortiz & Associates Consulting LLC to pay Vizio attorney fees after determining its failure to comply with the patent marking statute and meet discovery deadlines weakened its position, Judge William Bryson said in an opinion filed Wednesday in the US Court of Appeals for the Federal Circuit.
