VirnetX Surges as Court Denies Apple’s Bid to Delay Patent Fight

An appeals court issued orders rejecting efforts by Apple and Cisco to further delay VirnetX’s more than 9-year-old patent fight against Apple over secure communications.

  • The U.S. Court of Appeals for the Federal Circuit denied Apple’s request to either reconsider a January decision upholding an infringement verdict for VirnetX or to stay the mandate until a petition to the Supreme Court can be considered.
  • Apple argued that $439m verdict can’t stand because many of the patent claims that underpinned the verdict have since been ruled invalid in other Federal Circuit rulings.
