Retirement Unlimited Inc. notched an early win in a trademark fight launched by a much larger West Coast senior-living provider with a name similar to one of RUI’s facilities.
Judge Roderick C. Young of the US District Court for the Eastern District of Virginia ruled the businesses were so widely separated that consumers wouldn’t confuse RUI’s “The Westmont at Short Pump” senior living community in suburban Richmond, Virginia, with Westmont Living Inc.'s chain of senior-care facilities in California and Oregon, in a Nov. 3 opinion.
