US Patent and Trademark Office Director Kathi Vidal vacated an administrative tribunal decision rejecting a MAHLE Behr Charleston Inc. challenge to a patent covering a device to prevent corrosion in car radiators.
The Patent Trial and Appeal Board failed to evaluate MAHLE’s evidence that an earlier patent application disclosed certain dimensions in US Patent No. RE47,494 despite not defining precise proportions, Vidal said in a decision issued April 5.
Electrolysis Prevention Solutions LLC accussed Daimler Truck North America LLC of infringing the ‘494 patent in a 2021 lawsuit in the US District Court for the Western District of North Carolina. ...
