Vidal Awards VLSI $413,000 in Attorneys’ Fees Against OpenSky

US Patent and Trademark Office Director Kathi Vidal determined OpenSky Industries LLC—challenger of a patent underpinning a $675 million jury verdict against Intel Corp.—owes the patent’s owner $413,000 in attorneys’ fees due to abuse of the administrative process for patent review.

The director awarded patent owner VLSI Technology LLC 84% of what it sought in a redacted ruling issued Monday.

Vidal had previously found that OpenSky used the patent office’s inter partes review process “in an attempt to extract payment” from both VLSI, the owner of US Patent No. 7,725,759, and Intel in the wake of VLSI’s trial win. ...
