Verizon Escapes Infringement Suit After Traxcell Loses Patents

A federal judge in Waco dismissed a potential nine-figure patent infringement suit after the patents asserted against Verizon Wireless Personal Communications LP were ordered to be given up to a state court-appointed receiver.

The case is moot, Judge Alan D. Albright ruled, because, as of Tuesday, Traxcell Technologies LLC was required to turn over its patents—including those allegedly infringed by Verizon—to keep alive its challenge to a separate $1.5 million attorneys’ fees award in favor of Verizon and Sprint Communications Co.

“Based on the Receivership Order, Traxcell holds less than all substantial rights to the asserted patents,” Albright wrote. ...
