Vans’ ‘Wavy Baby’ Trademark Fight Paused Pending High Court Call

Vans Inc.'s high-profile trademark battle with the art collective MSCHF Product Studio Inc. over similar-looking shoes was paused by a federal appeals court because the US Supreme Court will soon hear a case that also tests the line between artistic expression and trademark enforcement.

On Thursday, the US Court of Appeals for the Second Circuit—which already heard oral arguments between Vans and MSCHF—stayed the case and ordered that both parties file additional briefs after the Supreme Court hands down a ruling in Jack Daniel’s Properties Inc. v. VIP Products LLC.
