Patent owner Symbology Innovations LLC didn’t give Valve Corp. time to request attorneys’ fees before telling a Texas federal judge plans to voluntarily dismiss patent infringement allegations, the video game developer said.
Symbology alerted the court it was dismissing its allegations against Valve and its customer Gearbox Software LLC and that each party would bear its own costs, according to the separate notices filed July 26 in the US District Court for the Eastern District of Texas. Chief Judge Rodney Gilstrap, who is presiding over the case, had invalidated the disputed patents in a separate one a day earlier.
