Utah State Weather Sensor Trade Secrets Win Backed by 10th Cir.

A weather sensor company can’t revive trade secrets claims against a specially created commercial arm of Utah State University, nor escape a breach-of-contract award that helped doom them, a federal appeals court ruled Wednesday.

GeoMetWatch Corp. failed to link behavior of the university’s Advanced Weather Systems Foundation (AWSF) and other defendants to its questionable claims of lost profits, the US Court of Appeals for the 10th Circut said. The court also rejected its bid to undo a $39,000 breach-of-contract counterclaim award, as well as GeoMetWatch’s pushback on a finding of sovereign immunity for AWSF.
