Utah Muralist Wins Copyright Ruling, But Fails to Prove Intent

An apparel company infringed a Utah artist’s copyright in his 100-foot mural by using it as a backdrop in social media promotion for a truck giveaway, a judge ruled, but determining the willfulness of the infringement and damages will require trial.

Diesel Power Gear LLC essentially conceded it infringed “Godlike” by Shae Petersen, known as SRIL, the US District Court for the Southern District of New York said as it awarded summary judgment. But though the company infringed twice in a three-year span, employee turnover and the speed with which offending posts were taken down raise questions about intent.
