USAA Mobile Check Deposit Patents Not Abstract, Magistrate Says

United Services Automobile Association patents related to a mobile check deposit system don’t cover abstract ideas ineligible for patenting, an Eastern District of Texas magistrate judge found.

PNC Bank NA, which USAA accused of infringement, wanted a ruling invalidating the patents. Judge Roy Payne recommended PNC’s eligibility defenses be dismissed in a Tuesday report.

Payne’s report comes as jury selection in the infringement trial is set for Monday in Marshall, Texas. PNC Bank has a chance to object.
