US Asks for New $1 Billion Trial Over Gilead HIV Drug Royalties

The US asked a federal judge in Delaware to overturn its loss in the billion-dollar patent infringement suit it filed against Gilead Sciences Inc. over a preventative treatment for HIV.

A jury voted last month to void three government-owned patents for the two-drug regimen that US officials claim was developed by researchers at the Centers for Disease Control and Prevention.

The government sued Gilead seeking royalties, after it says the pharmaceutical company exaggerated its role in developing the regimen and refused to obtain a license from CDC, even as it reaped more than $10 billion in sales.
