The Federal Circuit took the rare procedural step of electing to hear a case challenging President Donald Trump’s tariff program as a full court from the outset, rather than starting with the traditional three-judge panel.

Granting Trump’s request to stay a lower court’s order to undo sweeping tariffs imposed by the White House, the US Court of Appeals for the Federal Circuit revealed it chose to hear the case en banc on its own accord, without either party’s request.
