Presidential candidate Donald Trump infringed Eddy Grant’s 1983 hit “Electric Avenue” in a 2020 campaign video, a New York federal court ruled Friday as it rejected his fair use defense.
Trump’s use of the song “plays no discernible role in communicating the video’s overarching political commentary,” the US District Court for the Southern District of New York said. Grant’s bid for summary judgment over Trump’s fair use defense was granted, which established liability because that was Trump’s only pleaded defense.
