A golf cart battery company’s $4.7 million bench trial victory against a golf cart maker and its distributor will stand after the Fifth Circuit affirmed the trademark ruling.
Trojan Battery Co.'s win over Trojan EV LLC and Golf Carts of Cypress LLC should remain in place despite the lower court’s overbroad injunction, the US Court of Appeals for the Fifth Circuit said. A faulty finding that Trojan Battery established legally significant actual confusion also didn’t undermine the weight of the other confusion factors or the profit disgorgement calculation, the three-judge panel said.
