A patent battle in a Philadelphia federal court over devices for infants with misshapen ears can resume after an administrative tribunal found claims in two patents invalid following a review process that lasted 3 1/2 years and involved a trip to the Federal Circuit.
The Patent Trial and Appeal Board Wednesday found several claims in Becon Medical Ltd.'s US Patent No. 8,167,942 to be unpatentable as obvious.
