The seller of Curve treadmills accused a rival of infringing its trademark in a new suit filed as its separate patent-infringement lawsuit nears trial.
Woodway USA Inc. said LifeCORE Fitness LLC’s use of “Built For The Long Run” would confuse consumers of their motorless curved treadmills in a complaint filed Oct. 28 in the US District Court for the Southern District of California. It also said LifeCORE copied specific performance claims Woodway used to promote the durability and effectiveness of its Curve-branded treadmills, constituting false designation of origin and false advertising.
