Alabama-based powerboat manufacturer K2 Powerboats partially escaped a trademark battle with a competitor, K2 Marine Inc., over the use of the mark “K2" for selling powerboats in the Southeast.
US District Judge Emily C. Marks dismissed K2 Marine’s trademark infringement claim against K2 Powerboats, but allowed the Alabama state-law trademark dilution claim to remain.
K2 Marine first started selling custom powerboats in 2004 to dealers in Florida, Georgia, Louisiana, and other nearby states. The company sells to only one dealership in Gulf Shores, Ala.
