Trademark Office Establishes Rule for New Cancellation Routes

The U.S. Patent and Trademark Office has unveiled a rule to implement a new law aiming to get rid of fraudulent trademarks that undermine the integrity of the trademark register.

The new procedures are intended to provide a more streamlined and cheaper way to cancel a mark that was never used in commerce, the office said in its rule scheduled to be published in the Federal Register Wednesday.

The two new proceedings will be alternatives to the cancellation process at the Trademark Trial and Appeal Board. The filing fee for petitions will be $400, down from the $600 the office ...
