Adidas AG failed to revive its claim that Thom Browne Inc.'s two- and four-stripe shoes infringed its three-stripes trademark as the Second Circuit affirmed a jury’s verdict Friday.
The Germany-based shoemaker failed to show any errors in the lower court’s jury instructions, the US Court of Appeals for the Second Circuit said. The appeals court also rejected Adidas’ argument against decisions over expert testimony, as it preserved the fashion designer’s win.
